  • Order Processing: Lofhe acts as an intermediary between you and participating vendors. Vendors set the prices and availability of items, which may differ from in-store prices.
  • Refunds and Cancellations: Refunds, cancellations, and returns are subject to Lofhe’s policies. Once an order has been processed or delivered, refunds may not be available.

4. Delivery of Goods

Lofhe partners with independent contractors and third-party providers to fulfill deliveries. By placing an order for delivery, you acknowledge that:

  • Delivery times are estimates and may vary due to external factors.
  • You are responsible for ensuring the accuracy of your delivery address and instructions.
  • If you fail to accept delivery, you may be charged for the order.
  • Alcohol or restricted items require proof of age or identity upon delivery. If requirements are not met, the delivery may be canceled.

5. User-Generated Content

Certain features of the Services may allow you to submit content, such as reviews or feedback. By submitting content, you agree that:

  • You grant Lofhe a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, and display your content.

You agree to indemnify and hold Lofhe harmless from any claims, liabilities, damages, or expenses arising out of your use of the Services, violation of these Terms, or infringement of any third-party rights.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada and the Province of Ontario, excluding its conflict of laws provisions. Any disputes arising under these Terms will be resolved through:

  • Good Faith Negotiations: Users must attempt to resolve disputes with Lofhe amicably.
  • Arbitration: If negotiations fail, disputes may be submitted to binding arbitration in Ontario.

12. Amendments to the Terms

Lofhe may update these Terms periodically. The updated Terms will be posted on our website with the “Effective Date” noted. Continued use of the Services after changes are made constitutes acceptance of the updated Terms.
